Trespassing private property is the violation for not wearing a mask

Governor Cuomo reported business can make a list of guideline to follow such as wearing gloves, masks, etc as mandatory or optional. Businesses across NYC from CitiBank to ShopRite hired security to monitor all entering their locations requiring masks and gloves. If they don't, their violation is entering a private premise and police can be called to leave. Small business from local deli, liquor stores including franchise 7-Eleven can't afford security are often advised but not enforced. According to NYC Dept of Health, there are no guideline issued to business on public health for COVID-19.
