State Police arrest Halfmoon man following sexual assault investigation

On August 6, 2025, State Police of Clifton Park arrested Joshua Malacek, 40 of Halfmoon, NY for Rape in the third degree, Sexual Abuse in the second degree, Petit Larceny, Obstructing Governmental Administration in the second degree and Harassment in the second degree.

On August 6, 2025, at about noon Trooper received the report of a sexual assault. The investigation determined that during the previous overnight hours Malacek allegedly sexually assaulted an adult victim who was incapable of consent in Halfmoon, NY. Malacek also reportedly stole items from the victim’s home.

Malacek was arrested at his home and transported to SP Clifton Park for processing. He was then arraigned at the Halfmoon Town Court where he became highly uncooperative, kicking furniture and spitting on Troopers and in the direction of the Judge.
